The following general terms and conditions are written in English and can be downloaded in the clients active store. If you wish to have the general terms and conditions in digitalized or written mould you can order these under the following e-mail address: verkauf@antstore.net

With the delivery of goods every client receives these general terms and conditions additionally. The direction of ANTSTORE as well as the authorized representative of ANTSTORE is written down on the account.

Because of commercial purposes, you can find the homepage of ANTSTOREs Preamble under the domain: http://shop.antstore.net/. On these websites ANTSTORE is offering to its clients products, basically ants-colonies, formicaries and accessories which can be bought through the internet.

§ 1 Product election

(1) The client has the possibility to choose and order products at the above mentioned website.

(2) Concerning every product, the client receives a separate product description at the particular website. On demand, the client gets this product description on demand additionally in out printed mould, by receiving the ordered goods.

(3) At the website, the client can click on the products he is interested in. These will be collected in a virtual shopping cart and at the end of his purchase the client receives a products compilation with its final total charge, including the value added tax.

(4) Before the dispatch of the order ANTSTORE makes it possible for the client to check the order on content accuracy, especially on charge and amount, and if necessary to correct it.

§2 Countermentinstructions

Countermentlaw: Consumers have the right, to countermand their on the closing date of their agreement directed declaration of intent within two weeks.

The counterment does not need to have a motivation and needs to be explained to ANTSTORE in textform ( e.g. letter, fax , e-mail) or trough the return of the goods ;

For the protection of respite, an early enough dispatch of the counterment or the goods is satisfying. The deadline begins at the earliest by receiving the goods and a countermentinstruction in written form.

Countermentconsequences: In the case of an effective counterment, the from both sides received accomplishments need to be reguaranteed and if necessary the drawn uses have to be released. Can the received accomplishment be reguarenteed fully or partly not or only in a bad status, the salesman has to replace the value in this respect if necessary. By abandoning things, this is not the case, if the aggravation of the business is exclusively to attribute to its inspection, how it was for instance possible in the retail shop. By the way, a replacement of the value can be avoided, by not using the accomplishment as if it is yours and by omitting everything, which influences its value. Accomplishments which can be sent by package have to be send back.

The customer has to pay the costs of sending the goods back, if the delivered goods are these, which had been ordered and if the price of the back sent goods is not higher than 40,- € or if the customer did not yet pay a higher price of the accomplishment or if the customer did not yet render a service in return if there is a higher price of the accomplishment or a contractual agreed part payment to the time of countermand. Otherwise the return is exempt from charges or will be refunded to the buyer.
Accomplishments which cannot be sent by package will be picked up at the customers house.

The customer has to accomplish the commitments of restitution of payment within 30 days after the posting of the counterment declaration.

The countermentlaw does not exist, if goods have been delivered, which are labelled in § 312 d Abs. 4 BGB. This includes among other things:

- delivery of goods, which are produced towards clients specifications or which are clearly specific to the customers requirements or which are not appropriate to be sent back because of their condition, which can spool fastly or whose expiration date has been exceeded.

- delivery of audio- and video recordings or of software, as far as the delivered memories have been unsealed from the consumer.

- delivery of newspapers, magazines and glossies.

§3 Costs

(1) The costs from the list apply, at the moment of the order, to the costs presented on the websites.

(2) The prices are considered as from the domicile of ANTSTORE including sales tax, without costs for the packaging and the shipment.

§4 Conclusion of the contract

(1) The supply of ANTSTORE on the website is without engagement. Like that, ANTSTORE is not committed to an accomplishment in case of unavailability. A contract conclusion and for this reason a contractual commitment about the single benefits accomplishes, if ANTSTORE has confirmed the clients order in written form.

(2) ANSTRORE has the right to deliver goods of equal quality and price, if the ordered goods are not available and the customer affirms this procedure in the ordering form.

§5 Implementation of the contract

The handling of orders
ANTSTORE will handle orders on weekdays within 48 hours and will tell the client, if the favoured goods are available. We reserve us the right to cancel the order if it is not paid during 14 days.

Delivery
As far as the favoured goods are available, ANTSTORE will deliver these within 10 weekdays after the incoming payments of the corresponding order.

Shipping and handling
The forwarding charges inland will be calculated by weightiness, which will be shown shortly before the closing date of the order. The forwarding charges for goods which go abroad will be calculated in the elevation of the arising costs. Free shipping items must be included in a partial withdrawal (if the shipping was free below) subsequently paid or the entire order must be sent back.

Changes, upgradings, restrictions of the order
ANTSTORE will answer at short notice enquiries of the client in context with already given orders concerning changes, upgradings and / or restrictions of the product amount.

As far as the client wants a change, upgrading and / or restriction of the product before the planed delivery, ANTSTORE will consider this as far as possible. For this order changes and cancellations after a receipt of payment We charge a processing fee of € 2.50 gross.

Reservation animals
ordered by animals, which are to be sent away on customer's request at a later time, are computed with 0,50 €/day (care expenditure) from the day of the order up to the dispatch day.

§6 Service Hotline
ANTSTORE operates a hotline for the clients questions connected with the products. This hotline can be used five days a week (Monday to, Friday) during the hours of business ( 09:00 am to 4:00 pm). Hereunto the clients attention will be called once more by ANTSTORE in the account.

§7 Conditions of payment

(1) The client will receive an account from ANTSTORE for the ordered goods, which will be handed out with their delivery. ANTSTORE delivers the order against prepayment or account. Advance payment or orders for direct debiting from credit cards will be considered by issuing an invoice. If there is a delivery on account, all invoiced amounts have to be paid at the latest 14 days after the entry of the account.

(2) The prices on the account are always the final client prices including added value tax.

(3) Having a default of payment, the client, being the customer, is bound to pay to ANTSTORE the default interest amounting to 5 % over the base rate, unless ANSTORE can prove a higher interest rate. To clients, being businessmen, applies sentence 1, with the requirement that the default interest rate of 8 % is over the base rate. Arising bank charges are for the clients account.

§8 Guarantee and liability

(1) Deficiencies of the product will be advised to ANTSTORE by the customer and in addition to that the product will be transmitted at ANSTORE expense.

The guarantee of the provider acts in accordance with §§ 443 ff. BGB. In the corporate business connexions the guarantee is limited to one year and ANTSTORE has the right to repair the product, after you have chosen it , or to replace it for free. For living organisms (animals and plants) is to ensure 3 days.

(2) ANTSTORE is liable

At lightly negligent breach of duty, ANTSTOREs liablility is limited according to the type of goods predictable, contract typical direct average damage; this also counts for the liability of ANTSTOREs servants, assistants and legal agents. In addition to that, ANTSTORE is not liable for lightly negligent violations of unessential duties of the contract. The preceding liability limitations do not concern the requirements of the customer from product liability and other statutory obligatory instructions. Furthermore the limitation of liablitity does not apply, if ANTSTORE is responsible for an imputable violation of the clients live, body or health.

(3) Our statements about the attitude as well as. Species-regulations were transacted according to best knowledge and consciences. We don't give any guarantee on the correctness of the statements.

§9 Responsibility

You cannot exclude that living animals can cause damages and can also transmit diseases (special risk for allergic persons). The delivery will be carried out at the customers own risk. If exotic breeds should break out of the designed installations, you have to call immediately an exterminator. We assume no liability for consequent damages, with exception for gross negligence acting of ANTSTORE. In order to no endanger the internal as well as external faunas, we ask you to abandon none of the from us received animals in the great outdoors. We offer a free reset of old colonies.

Notice: The deployment of animals into the nature is only with official authorisation permitted, towards the current conservation-laws of the countries.

§10 Force majeure

(1) In case ANTSTORE does not perform the owing services due to force majeure (especially war, nature disasters), it is free from its liablility during the constancy of the estoppel.

(2) Is it impossible for ANTSTORE to accomplish the order and to deliver the goods respectively longer than one month because of force majeure, the client has the right to resign from the contract.

§11 Data protection
ANTSTORE will follow all data protection legal demands, especially the guidelines of the teleservice data protection law.

§12 Final terms

(1) The agreement language is English.

(2) Should one appointment of these conditions be or become void by law, the conditions stay operative. ANTSTORE and the client will replace the null and void regulation by such an effective one, which approaches the will of the contracting parties economically the most.
